Notice of Privacy Practices (HIPAA)
Effective Date: September 1, 2026
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Our Commitment to Your Privacy
Danbury Bright Smiles LLC (“we,” “us,” or “our practice”) is required by law to protect the privacy of your protected health information, to give you this Notice explaining our legal duties and privacy practices, and to follow the terms of the Notice currently in effect.
Protected health information, or PHI, means information that identifies you and relates to your dental or medical care, or to payment for that care. This includes your chart, x-rays and photographs, treatment plans, appointment history, insurance information, and billing records.
How We May Use and Disclose Your Health Information
We may use and disclose your PHI without your written authorization for the following purposes:
-
Treatment. We use your health information to provide dental care. For example, your dentist may review your medical history and current medications before administering anesthetic, and we may share information with a specialist such as an oral surgeon, endodontist, or orthodontist to whom we refer you.
-
Payment. We use and disclose your health information to bill and collect payment for treatment. For example, we may send a claim to your dental plan containing your diagnosis, the procedures performed, and supporting x-rays, or verify your eligibility and benefits before a visit.
-
Health Care Operations. We use your health information to run our practice. Examples include quality review of the care we provide, staff training and evaluation, licensing and accreditation activities, and business planning.
-
Appointment Reminders. We may contact you by phone, text message, email, postcard, or letter to remind you of a scheduled appointment or that it is time to schedule one.
-
Treatment Alternatives and Health-Related Benefits. We may contact you about treatment options, or about services and products that may be of interest to you.
-
Individuals Involved in Your Care or Payment. We may share information with a family member, relative, close friend, or other person you identify, when that information is directly relevant to their involvement in your care or in payment for your care. If you are not present or are unable to agree or object, we will use our professional judgment to decide whether disclosure is in your best interest.
-
Disaster Relief. We may disclose information to an authorized organization assisting in disaster relief so your family can be notified of your condition and location.
Other Uses and Disclosures Permitted or Required Without Your Authorization
The law permits or requires us to use or disclose your PHI without your authorization in the following circumstances:
-
When required by federal, state, or local law.
-
For public health activities, such as reporting communicable disease, adverse events involving products regulated by the FDA, or product recalls.
-
To report suspected abuse, neglect, or domestic violence to an authorized government agency.
-
For health oversight activities, including audits, investigations, inspections, and licensure actions.
-
In response to a court or administrative order, subpoena, discovery request, or other lawful process.
-
For law enforcement purposes, such as identifying or locating a suspect, fugitive, material witness, or missing person, or reporting a crime on our premises.
-
To coroners, medical examiners, and funeral directors as necessary for them to carry out their duties.
-
To organ procurement organizations for the purpose of facilitating donation and transplantation.
-
For research, when an institutional review board or privacy board has approved the research and established protocols to protect your privacy.
-
To prevent or lessen a serious and imminent threat to the health or safety of you or another person.
-
For specialized government functions, including military and veterans activities, national security and intelligence, and protective services for the President.
-
As authorized by and to the extent necessary to comply with workers’ compensation laws.
-
To correctional institutions or law enforcement officials if you are an inmate or in custody.
Uses and Disclosures That Require Your Written Authorization
The following always require your signed, written authorization:
-
Marketing. Most uses and disclosures of your PHI for marketing purposes, including the use of your photographs or treatment images on our website, social media accounts, or advertising.
-
Sale of your health information. We do not sell your health information, and we would not do so without your written authorization.
-
Psychotherapy notes. Most uses and disclosures of psychotherapy notes, if any such notes exist.
-
Any other purpose not described in this Notice.
If we receive any direct or indirect payment in connection with a marketing use of your information, the authorization will say so. You may revoke an authorization at any time by submitting your revocation in writing to our Privacy Officer. Revocation stops future uses and disclosures, but does not undo any use or disclosure we already made while the authorization was in effect.
Your Rights Regarding Your Health Information
-
Right to inspect and copy. You may inspect and obtain a copy of your dental records, including x-rays and billing records, in paper or electronic form. Submit your request in writing to our Privacy Officer. We may charge a reasonable, cost-based fee for copies. In limited circumstances we may deny a request, and you may ask that the denial be reviewed.
-
Right to request an amendment. If you believe information in your record is incorrect or incomplete, you may request in writing that we amend it, including your reason for the request. We may deny the request if the information was not created by us, is not part of the records we maintain, is not information you would be permitted to inspect and copy, or is accurate and complete. If we deny your request, you may submit a statement of disagreement that will be included with your record.
-
Right to an accounting of disclosures. You may request a list of certain disclosures we made of your health information. The accounting will not include disclosures made for treatment, payment, or health care operations, disclosures made to you, or disclosures you authorized. The first accounting in any twelve-month period is provided without charge.
-
Right to request restrictions. You may ask us to limit how we use or disclose your information for treatment, payment, or health care operations, or to limit what we share with someone involved in your care. We are not generally required to agree, but if we do agree, we will honor the restriction except in an emergency.
-
Right to restrict disclosure to your health plan. You have the right to restrict disclosure of information to your dental or health plan about a service or item for which you paid our practice in full, out of pocket. We are required to honor this request, provided the disclosure is not otherwise required by law. Please tell us at the time of service if you wish to exercise this right.
-
Right to request confidential communications. You may ask us to contact you in a specific way, such as only by cell phone, or to send mail to an alternate address. We will accommodate all reasonable requests and will not ask you to explain why.
-
Right to a paper copy of this Notice. You may request a paper copy of this Notice at any time, even if you agreed to receive it electronically.
-
Right to be notified of a breach. We will notify you if a breach occurs that may have compromised the privacy or security of your health information.
Our Responsibilities
We are required by law to maintain the privacy and security of your protected health information, to give you notice of our legal duties and privacy practices, to notify you following a breach of unsecured health information, and to abide by the terms of the Notice currently in effect. We will not use or disclose your information for any purpose not described in this Notice without your written authorization.
Changes to This Notice
We reserve the right to change this Notice and to make the revised Notice effective for health information we already hold as well as information we create or receive in the future. The current Notice is posted in our reception area and on our website at danburybrightsmiles.com, and shows its effective date. You may request a copy at any visit.
